Agencies are also adjudicatory. In other words, they work like courts and hand down judgments regarding issues which arise in the context of their programs. When an agency adjudicates, it performs trial-type procedures which are similar to civil trials performed by the judicial branch of government.4 Parties participate in hearings, present evidence and testimony, conduct cross-examinations, and develop a written record. Hearings take place before a neutral administrative lawjudge. Finally, agency adjudications may be appealed within an agency as well as to state or federal courts.
