Anticipating and Dealing with Contract Problems

Even with a well conceived and properly executed contract, each party must be prepared to address problems that can and often will arise during the execution of a project to ensure that the work is completed expeditiously and in accordance with the contract documents. Issues particular to project completion, payment of funds, liability, and warranty are typically detailed in the general conditions section of the project specification. These conditions should clearly delineate responsibility of the owner, contractor, and any subcontractors.

There are several layers of responsibility in the typical project; that between owner and engineer, owner and contractor, and contractor and subcontractor. Interwoven throughout the contractor and subcontractor relationships is also generally input and inspection by the engineer of record. Because of these layers of responsibility, groups that may not be party to a dispute can be unfairly affected by those disputes.
